Introduction

This Privacy Policy explains what information TardiGeddon uses, why, and the rights you have. In short: there are no adverts and no tracking, we count visits only in a privacy-friendly way that uses no cookies, and you can play everything without an account. The game remembers your settings on your own device, and our online game server only uses what it needs to run the match you are playing, then forgets it. If you choose to create an account, we keep your email address and player name so your shop items follow you to any device, and if you buy something we keep a record of the purchase. Accounts and the shop are being introduced; this Policy describes how they work once they are available.

Section 1 — About This Policy

1.0 Scope

1.0.1 This Privacy Policy explains how EVCV Limited collects, uses, discloses, retains, and safeguards personal data when you visit the Website, play TardiGeddon, use our online game server, or contact us, and explains your rights under the UK General Data Protection Regulation ("UK GDPR"), the Data Protection Act 2018, and, where applicable, the EU General Data Protection Regulation ("EU GDPR").

1.0.2 This Policy applies to all personal data processed by the Company in connection with the Website and Services.

1.1 Data Controller

1.1.1 EVCV Limited ("we", "us" or "our") is the controller for personal data described in this policy unless we act as a processor for a business customer. We are registered in England and Wales under company number 13570383 at 28 Oak Tree Lane, Cookhill, Alcester, Warwickshire, B49 5LH, United Kingdom. This applies for the purposes of the UK GDPR and, where applicable, the EU GDPR. We are registered with the Information Commissioner's Office (ICO) under registration number ZB232228.

1.2 Related Documents

1.2.1 This Policy should be read alongside our Cookie & Storage Policy and our Children's Privacy Policy.

Section 2 — Information We Collect

2.0 Information Stored Only on Your Device

2.0.1 The game saves the following in your browser's local storage on your own device, so that it remembers your choices: your team names, team colours, hats, and tardigrade names; the arena theme you chose; your chosen game style and custom rules; how many players you set up and whether each is a human or the computer; the computer's skill level; whether you have started the tutorial; your language and text size, sound settings, match music and sound pack; the players you have blocked in online play (the id our server gave them and the team name you saw); replays of the last few matches you played; the maps you saved in the map editor; and, if you have signed in, a list of the shop items your account owns, so they stay unlocked when you play offline.

2.0.2 When you join an online room, the game also keeps the room code and a random rejoin token in your browser's session storage, so you can get back into your match if your connection drops. If you change your controls on the Settings page (which keys, mouse buttons and touch buttons do what), the game keeps them there too. This is deleted when you close the tab.

2.0.3 This information stays on your device. In our Android app, it is kept in the app's own storage on your device instead of a browser's. It is not sent to us, except as described in Section 2.1 when you play online and in Section 2.2 if you have an account, and you can delete it at any time by clearing your browser's site data.

2.0.4 In our Android app, when you open the coin packs in the shop, the app asks Google Play for your age range (for example "13 to 15" or "18 and over"), using Google's Play Age Signals service. Google may first ask you, or a parent or carer through Google Family Link, whether to share it. The app uses the answer only to adjust buying coins: it reminds players under 18 that a parent or carer may need to approve purchases, and switches buying coins off while a parent or carer has not yet approved the latest version of the app, or while Google needs to confirm your age. The answer is kept in the app's memory until you close it: it is not saved on your device, not sent to us, and not used for anything else. We do this because Brazil's Digital Statute of Children and Adolescents (Digital ECA) asks apps that children and teenagers may use to take account of the age range app stores provide.

2.1 Information Used When You Play Online

2.1.1 When you play online, your device connects to our game server and sends: your team name, team colour, hat, and tardigrade names; the room code you create or join; if you host a room on a map you made in the map editor, that map (it is shown to the other players in the room); and your game inputs (such as moving, aiming, and firing) during your turns.

2.1.2 Your Team Details are shown to the other players in your match. Please do not use your real name or other personal information in them. The game and our server refuse names with rude words, phone numbers, email or website addresses or social media. In quick play, where you are matched with people you don't know, other players see a made-up team name and standard tardigrade names instead of the names you chose.

2.1.3 As with any internet connection, our server and our hosting providers necessarily receive your device's IP address in order to send data back to you. We do not use your IP address to identify you, and we do not store it in our own records.

2.1.4 The server keeps match information in memory only while the match or lobby is in use. It is deleted when the room closes (at the latest about two minutes after the last player leaves) or when the server restarts. We do not keep match histories or chat logs.

2.1.5 If you are signed in when you play online, the server also checks which shop items your account owns, so that only the hats you own are shown to other players, and adds the result of each finished match to your account's stats. When you finish a one-player game against the computer while signed in, the game sends us its result for your stats too. It does not tell other players who you are: they only see your Team Details.

2.1.6 Reports and blocking. If another player reports you, or you report another player (Community Guidelines, Section 5), our server emails a report to our support team. It contains the reason chosen, the room code, the time, the team and tardigrade names each of you chose (and, in quick play, the made-up names that were shown), and, for each of you who is signed in, your account id. So that blocking works, the server gives each player an id that other players' devices can store when they block them: for a signed-in player it is worked out from the account (it stays the same, but cannot be used to find out who you are or look up your account); for anyone else it is random and new each visit.

2.2 Your Account (Optional)

2.2.1 You do not need an account to play. If you create one, we collect and store:

  • your player name and email address;
  • your password, which is stored only in scrambled ("hashed") form, so that nobody, including us, can read it;
  • if you sign in with Google or Apple instead of a password: the name, email address, profile picture link and account identifier that Google or Apple share with us, and the sign-in tokens they issue, which we need to complete sign-in;
  • when your account was created and last updated, and whether you have confirmed your email address;
  • the items your account has unlocked, and how (with coins, Slime, a gift, a promotional code, or an earlier direct purchase);
  • if you send or claim gifts: for each gift, the item, its price in coins, the preset message chosen, when it was bought, claimed or taken back, the account that bought it and the account that claimed it, and the last four characters of its code. We keep the full code only in scrambled ("hashed") form, so it cannot be read back from our records;
  • your coin and Slime balances, and how much Slime you have earned from games against the computer today (for the daily limit);
  • your control settings, if you change them on the Settings page while signed in (which keys, mouse buttons and touch buttons do what), so they follow you to any device;
  • your game stats while signed in: online games and one-player games against the computer played and won, win streaks, how many tardigrades you have popped, the damage you have dealt, and your own goals (damage to, and pops of, your own team), and your quick-play rating (a number that goes up and down with your quick-play results, used to match you with players of a similar level). They are shown to you, not to other players.
  • your friends, if you add any while signed in: your friend code, the players you've asked or accepted, and when. Only players who have both accepted each other are friends. Your friends can see your player name, whether you're on the online screen, and the code of a private room you're in so they can join it; they can send you an invite to their room. There is no chat. You can remove a friend or cancel a request at any time, and deleting your account removes your friends list.
  • your daily challenge scores, if you send them while signed in: which challenge, the day, your best result (targets popped or race time) and when you set it. To check a score, the game sends us the buttons pressed during that run; we play it back on our server and then discard it, keeping only the result. Your best result for each day's challenge is shown on the public leaderboards in the game and on our Website, next to your account's player name (not your email). If you don't want to appear, don't send a score, or ask us to remove it.

2.2.2 While you are signed in, our server keeps a sign-in session: a random code, which is also stored in a cookie on your device (see our Cookie & Storage Policy), the account it belongs to and when it expires. We do not store your IP address or details of your device or browser with it. Your IP address is used briefly, in memory only, to limit repeated sign-in attempts and protect accounts from password guessing.

2.2.3 Your account name and email address are not shown to other players, with one exception: when someone claims a gift you sent, they see your player name and the message you chose (see our Terms of Service, Section 5.8). Your email address is never shown.

2.2.4 When you create an account, we ask you to confirm that you are 13 or older and that you agree to our Terms of Service. We do not ask for or store your date of birth.

2.2.5 Account emails. We send you an email with a link to confirm your email address when you create an account (and again if you ask), and an email with a link to choose a new password if you use "Forgot password?". These are service emails needed to keep your account secure, not marketing, and we only send them when you sign up or ask for one. Each email contains your player name and a one-time link. A password reset link works once, for one hour; we store its code until it is used or expires, then delete it. An email confirmation link works for 24 hours and is not stored by us. If you did not ask for an email, you can ignore it.

2.3 Purchases

2.3.1 Payments are handled by Stripe on its own secure payment page. Your card or other payment details go directly to Stripe; we never see or store your full card number.

2.3.2 Money is only ever spent on coin packs. When you buy your first coin pack, we ask Stripe to create a customer record for you with your email address and player name, so that all your purchases and receipts are kept together; we keep Stripe's reference for it with your account. For each purchase we send Stripe the coin pack and its price and an identifier for your account. Stripe acts as the merchant of record for the payment (see our Terms of Service, Section 5.1.3): on its payment page it asks for the details it needs to take payment and work out the VAT or sales tax that applies, such as your country or address, and it emails you a receipt. We receive back, and keep, a purchase record: the item, how many coins it gave, the amount and currency, the date, the country of the payment (when Stripe gives it), Stripe's references for the payment, whether it has been refunded or disputed, the account it was for, the time you confirmed that you wanted the item straight away, and the time you confirmed you were 18 or over or had a parent's or guardian's agreement (see our Terms of Service, Section 5).

2.3.3 Stripe also uses payment information for its own purposes, such as preventing fraud and meeting its legal obligations, as described in its own privacy policy at https://stripe.com/privacy.

2.3.4 In our Android app, coin packs are bought through Google Play's billing system instead, and Google takes the payment as the seller, under its own terms and privacy policy (https://policies.google.com/privacy). We never see your payment details. When you start a purchase, the app gives Google a code made from your account identifier by a one-way calculation (a "hash"), so that we can check the purchase belongs to your account without Google learning which account it is. Google gives the app a purchase reference, which the app sends to our server; our server then asks Google whether the purchase is complete and genuine, and later whether it has been refunded. We keep a purchase record as in Section 2.3.2: the coin pack, how many coins it gave, its list price in pounds (or nothing, for Google's test purchases), the date, the billing country Google gives us, Google's purchase reference, whether it has been refunded or disputed, and the account it was for.

2.3.5 With your account we also keep a record of where the coins in your wallet came from: which purchase (or bonus) each batch of coins came from, its country and what it cost, and how many of those coins you have not spent yet. We use it to keep your wallet correct when a purchase is refunded or a gift is cancelled, and to meet the law in countries that treat unspent paid coins as prepaid credit, such as Japan's Payment Services Act, which requires us to know the value of unspent coins bought by players in Japan. It is deleted with your account.

2.4 Visit Statistics

2.4.1 We use Cloudflare Web Analytics to count how many people visit the Website and the game, which pages they open, roughly which country they are in, what kind of device and browser they use, which website (if any) sent them to us, and how quickly pages load. When a page loads, a small script from Cloudflare sends these details, together with your device's IP address as part of the connection, to Cloudflare.

2.4.2 Cloudflare Web Analytics does not use cookies or store anything on your device, and does not follow you between visits or across other websites. We only see totals (for example, "200 visits from the UK today"); we cannot see who you are or pick out any one person's visits.

2.5 Information You Send Us

2.5.1 If you email us (for example, for support or to make a privacy request), we will receive your email address and anything you include in your message.

2.6 Information We Do Not Collect

2.6.1 We do not use advertising or tracking technologies, and the only analytics we use are the cookie-free visit statistics described in Section 2.4. The only cookies we use are the strictly necessary sign-in cookies described in our Cookie & Storage Policy, and only if you sign in. We do not ask for your age, location, or contact list, and you can play without giving us your name or email address. The game's fonts and code are served from our own Website, so playing does not send your data to font or analytics services.

2.6.2 We do not intentionally collect special category personal data (such as data concerning health, religion, or sexual orientation), and you should not include any in your Team Details or messages to us.

Section 3 — How We Use Your Information

3.0 Purposes of Processing

3.0.1 To run the game on your device and remember your settings.

3.0.2 To run online matches: creating and joining rooms, matching players in quick play, keeping every player's game in step, and letting you rejoin a match after a dropped connection.

3.0.3 To protect the Services and other players, for example by limiting how quickly a single connection can create rooms, rejecting malformed data, and removing players who break our Community Guidelines.

3.0.4 To respond to your emails and requests.

3.0.5 To understand, in total, how many people visit the Website and play the game and how well pages load, so that we can improve them (Section 2.4).

3.0.6 If you create an account: to sign you in, keep your account secure, keep track of the shop items you own on every device, and let you delete your account.

3.0.7 If you buy something: to take payment through Stripe (or, in the Android app, Google Play), deliver the item, handle refunds and disputes, and prevent fraud.

3.0.8 To comply with legal obligations, such as keeping accounting and tax records, and to respond to lawful requests from public authorities.

3.1 Legal Basis for Processing (UK/EU GDPR)

3.1.1 Performance of a contract: providing the game and the online matches you ask to play, your account if you create one, and the items you buy (Sections 3.0.1, 3.0.2, 3.0.6 and 3.0.7).

3.1.2 Legitimate interests: keeping the Services and accounts secure and fair, preventing payment fraud, answering your messages, and counting visits so we can improve the Services (Sections 3.0.3, 3.0.4, 3.0.5 and 3.0.7). These interests do not override your rights, because we use very little data and keep it only as long as described in Section 5.

3.1.3 Legal obligation: where we must keep or disclose information by law, including keeping records of sales for tax purposes (Section 3.0.8).

3.1.4 Storing your settings on your device is strictly necessary to provide the features you use, as described in our Cookie & Storage Policy.

Section 4 — How We Share Your Information

4.0 Categories of Recipients

4.0.1 Other players in your online match, who see your Team Details and the effects of your moves.

4.0.2 Our hosting providers, acting as our processors: Cloudflare, Inc. (which serves the Website and game files, and provides our visit statistics), Fly.io, Inc. (which runs the online game server in its London region) and Neon (which hosts our account database in London, on Amazon Web Services). They process data such as IP addresses and, for Neon, the account and purchase data described in Sections 2.2 and 2.3, to deliver and protect their services, under contracts that include data protection obligations, and may keep short technical logs under their own policies.

4.0.3 20i Limited, a UK company, acting as our processor, which sends the account emails described in Section 2.2.5 on our behalf from its mail servers in the United Kingdom. It receives your email address, your player name and the content of the email, and keeps delivery logs for a limited time under its own policies.

4.0.4 Stripe, which takes payments for us as the merchant of record. For the payment, and the tax and accounting records that go with it, Stripe is an independent controller of your data under its own privacy policy at https://stripe.com/privacy; it also uses payment information for its own purposes such as fraud prevention and legal compliance (see Section 2.3.3).

4.0.4A Google, for coin packs bought in our Android app: Google takes the payment as the seller and is an independent controller of the payment data under its own privacy policy at https://policies.google.com/privacy (see Section 2.3.4).

4.0.5 Google or Apple, only if you choose to sign in with them. They will know that you used your Google or Apple account to sign in to TardiGeddon, under their own privacy policies.

4.0.6 Professional advisers, regulators, law enforcement agencies, courts, or other public authorities, where required or permitted by law, or to protect the rights, property, or safety of the Company, our players, or others.

4.0.7 A prospective buyer, investor, or successor entity, in connection with an actual or proposed merger, acquisition, reorganisation, or sale of some or all of the Company's assets, subject to appropriate confidentiality arrangements.

4.1 We Do Not Sell Personal Data

4.1.1 The Company does not sell or share personal data for advertising, and does not use advertising cookies or pixels.

4.2 International Transfers

4.2.1 Our game server and account database are hosted in London, but several of our providers (including Cloudflare, Fly.io, Neon and Stripe) are based in the United States or operate worldwide networks, and 20i may use subcontractors outside the United Kingdom, so some data may be processed outside the United Kingdom. Where this happens, we rely on recognised safeguards, such as the UK Extension to the EU–US Data Privacy Framework or the UK International Data Transfer Addendum to the EU Standard Contractual Clauses.

4.2.2 You may request further information about these safeguards by contacting [email protected].

Section 5 — Data Retention

5.0 Retention Principles

5.0.1 We retain personal data only for as long as necessary for the purposes described in this Policy.

5.1 Retention Periods

5.1.1 Settings stored on your device: until you change them or clear your browser's site data. We cannot see or delete them for you.

5.1.2 Online match data: in server memory only while the room is in use, and deleted at the latest about two minutes after the last player leaves.

5.1.3 Emails you send us: for as long as needed to deal with your message, and then for up to 24 months in case of follow-up questions, unless the law requires longer.

5.1.4 Your account (Section 2.2.1), including the items it owns, its coin and Slime balances, your game stats, your friends list and your daily challenge scores: until you delete it. You can delete your account at any time in the game (Account, then Delete account), or by emailing [email protected]. Deleting it removes your account details and items straight away from our live database; copies in our database provider's backups are overwritten within its normal backup cycle. Records of gifts you sent or claimed stay while the other account exists, so it can still claim or see them, but the link to your deleted account is removed.

5.1.5 Sign-in sessions: each lasts up to 7 days after you last used it, is ended when you sign out, and is deleted from our database within about an hour of expiring.

5.1.6 Purchase records (Section 2.3.2): for six years after the end of the financial year in which the purchase was made, as required for our accounting and tax records. If you delete your account, we remove the link between your purchase records and your account; we keep the records themselves for that period. Stripe, and Google for purchases in the Android app, keep their own records under their privacy policies.

5.1.7 Visit statistics (Section 2.4): we only see totals, which do not identify anyone. Cloudflare keeps the underlying data for a limited time under its own policies.

5.1.8 Player reports (Section 2.1.6): for up to 24 months after we have dealt with them, so we can spot repeated problems, unless the law requires longer.

Section 6 — Your Rights

6.0 Data Subject Rights

6.0.1 The right of access — to obtain confirmation that we are processing your personal data and to receive a copy of it.

6.0.2 The right to rectification — to have inaccurate or incomplete personal data corrected.

6.0.3 The right to erasure ("right to be forgotten") — to have personal data deleted in certain circumstances.

6.0.4 The right to restrict processing — to limit how we use your personal data in certain circumstances.

6.0.5 The right to object to processing — including processing carried out on the basis of legitimate interests.

6.0.6 The right to data portability — to receive personal data you have provided to us in a structured, commonly used, machine-readable format.

6.0.7 The right to withdraw consent — where processing is based on consent, without affecting the lawfulness of processing carried out before withdrawal.

6.0.8 Rights related to automated decision-making — we do not make decisions about you based solely on automated processing that have legal or similarly significant effects. (The game's computer opponents play the game; they do not make decisions about you.)

6.0.9 The right to lodge a complaint with the Information Commissioner's Office ("ICO") at www.ico.org.uk, or with your local supervisory authority if you are located in the EEA.

6.1 Exercising Your Rights

6.1.1 To exercise any of these rights, please contact [email protected]. If you have an account, please write from the email address it uses, so that we can confirm the request is yours. You can also delete your account yourself at any time in the game. If you do not have an account, we keep online match data only briefly, so we will usually hold no personal data about you other than any emails you have sent us; we will tell you if that is the case.

6.1.2 We will respond to valid requests within one calendar month, extendable by a further two months for complex or numerous requests.

Section 7 — Security

7.0 Safeguards

7.0.1 We use appropriate technical and organisational measures to protect personal data, including encrypted connections (HTTPS and secure WebSockets) between the game and our servers, an encrypted connection to our account database, passwords stored only in hashed form, sign-in cookies that the game's code cannot read, limits on repeated sign-in attempts, checks that payment notifications really come from Stripe and that purchases made in the Android app are confirmed with Google, checks that reject malformed data, limits on how quickly a connection can send messages or create rooms, and keeping as little data as possible for as short a time as possible.

7.0.2 No method of transmission over the internet or method of electronic storage is completely secure. While we strive to protect your personal data, we cannot guarantee its absolute security.

7.1 Data Breach Notification

7.1.1 In the event of a personal data breach that poses a risk to your rights and freedoms, we will notify the ICO within 72 hours of becoming aware of the breach, and will notify affected individuals without undue delay where the breach is likely to result in a high risk.

Section 8 — Marketing Communications

8.0 No Marketing

8.0.1 We do not send marketing communications, and the game does not show adverts. Creating an account does not sign you up for marketing. If this changes, we will only send marketing with your consent, and you will always be able to opt out.

Section 9 — Children's Privacy

9.0 Children

9.0.1 TardiGeddon is a cartoon game that children may enjoy. The game can be played without an account, and without giving us a name, email address, age, or location, so we collect as little information as possible from every player, including children. Accounts are only for people aged 13 or over, and we ask players under 18 to get a parent's or carer's permission before buying anything. In our Android app, the shop also takes account of the age range Google Play provides (Section 2.0.4). Please see our Children's Privacy Policy for further detail.

Section 10 — Regional Supplements

10.0 European Economic Area and Swiss Residents

10.0.1 Where the EU GDPR applies to our processing of your personal data — for example, because you are located in the EEA — you have rights equivalent to those described in Section 6, and may lodge complaints with your local supervisory authority.

10.1 United States Residents

10.1.1 We do not sell or share personal information for cross-context behavioural advertising, as those terms are used in US state privacy laws, including the California Consumer Privacy Act.

10.2 Other Jurisdictions

10.2.1 We aim to comply with applicable data protection laws in the jurisdictions in which we operate. If you have questions about your rights under a specific local law not otherwise addressed in this Policy, please contact [email protected].

Section 11 — Future Changes to the Services

11.0 Mobile Apps

11.0.1 We plan to release TardiGeddon as an app for phones and tablets. Purchases in those apps will be made through Apple's or Google's own payment systems. We will update this Policy before the apps become available.

Section 12 — General Legal Provisions

12.0 Entire Agreement

12.0.1 This document, together with any other policies referenced within it, constitutes the entire agreement between you and the Company relating to its subject matter, and supersedes all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral, relating to that subject matter.

12.1 Severability

12.1.1 If any provision of this document is found by a court or other competent authority to be invalid, unlawful, or unenforceable, that provision will be deemed modified to the minimum extent necessary to make it valid, lawful, and enforceable.

12.1.2 If such modification is not possible, the relevant provision will be deemed deleted, and the validity and enforceability of the remaining provisions will not be affected.

12.2 Waiver

12.2.1 No failure or delay by the Company in exercising any right, power, or remedy under this document shall operate as a waiver of that right, power, or remedy, nor shall any single or partial exercise preclude any other or further exercise.

12.2.2 Any waiver of any provision of this document will only be effective if given in writing by an authorised representative of the Company.

12.3 Assignment

12.3.1 You may not assign, transfer, or sub-contract any of your rights or obligations under this document without the prior written consent of the Company.

12.3.2 The Company may assign, transfer, or sub-contract any of its rights or obligations under this document at any time, including in connection with a merger, acquisition, corporate reorganisation, or sale of all or substantially all of its assets, provided such assignment does not materially diminish the rights you have been granted.

12.4 Force Majeure

12.4.1 The Company shall not be liable for any failure or delay in performing its obligations under this document where such failure or delay results from circumstances beyond its reasonable control, including but not limited to acts of God, natural disaster, war, terrorism, civil unrest, industrial action, government action, pandemic, power or telecommunications failure, or failure of third-party suppliers or hosting providers.

12.5 No Third-Party Rights

12.5.1 Except as expressly stated, this document does not confer any rights on any third party under the Contracts (Rights of Third Parties) Act 1999 or otherwise, and no third party shall have any right to enforce any of its provisions.

12.6 Relationship of the Parties

12.6.1 Nothing in this document shall be construed as creating a partnership, joint venture, agency, or employment relationship between you and the Company.

12.7 Notices

12.7.1 Any notice required to be given under this document shall be in writing and shall be delivered by email to the relevant address specified in the Company Details section above, and shall be deemed received 24 hours after being sent, provided no delivery failure notification is received. We may give notices to you by publishing them on the Website or in the game, or, if you have an account, by email to the address on your account.

12.8 Language and Translation

12.8.1 This document is drafted in English. Any translated versions are provided for convenience only, and in the event of any conflict or inconsistency between the English version and a translated version, the English version shall prevail.

12.9 Survival
